HSBC’s Swiss Unit Faces Preliminary Charges Over Embezzlement Claims

HSBC’s Swiss division is currently under preliminary charges by French prosecutors. This move comes after allegations that the bank facilitated the former Lebanese central bank governor, Riad Salameh, in embezzling funds. Le Monde was the first to report these charges.

Investigation Into HSBC’s Alleged Conspiracy

The Paris financial prosecutor’s office is spearheading the investigation against HSBC, the largest bank in Europe. The bank stands accused of several offences, including misuse of public money, public official bribery, and breach of trust. According to the French judicial system, such preliminary charges imply that prosecutors find sufficient evidence to authorize a detailed investigation under the supervision of an examining magistrate.

In the future, this magistrate will decide whether the case has enough merit to proceed to trial or if it should be dismissed. Last year, HSBC disclosed that both Swiss and French authorities were investigating its alleged involvement in money laundering tied to “two historical bank relationships”. The bank also warned that the potential repercussions of these investigations could be substantial.

HSBC’s Private Banking Arm Severed Ties

In the aftermath of the investigations, HSBC’s private banking division severed its ties with over 1,000 affluent clients from the Middle East, including individuals from Saudi Arabia and Lebanon as reported by the Financial Times.

Swiss Regulator Identified Serious Failures

Switzerland’s financial regulator, Finma, noted in 2024 that it had found severe lapses in anti-money laundering measures connected to transactions worth more than $300 million between Switzerland and Lebanon. Consequently, Finma instructed HSBC to review its high-risk client relationships. The regulator initiated enforcement proceedings in 2021.

Accusations Against Salameh Brothers

Switzerland’s attorney-general has alleged that Salameh and his brother, Raja Salameh, transferred over $300 million from Lebanon’s central bank to an HSBC Switzerland account registered under Forry Associates. These transactions allegedly took place between 2002 and 2015. It is further claimed that hundreds of millions were subsequently redirected from Forry to Swiss bank accounts under the brothers’ control.

In 2021, Finma began enforcement proceedings against HSBC over its dealings with the Lebanese clients. In 2022, Beirut prosecutors charged Salameh with embezzling upwards of $330 million in public funds. Salameh denies all the allegations, maintaining that his wealth accumulation was solely through his financial career before entering public service. His brother, Raja Salameh, has also denied any wrongdoing.

In conclusion, HSBC’s Swiss unit is under intense scrutiny from various regulatory bodies for its alleged role in facilitating money laundering and embezzlement. The outcome of these investigations could have a significant impact on the bank and its operations.
